Frivolous Lawsuits 

You may have heard of the Florida woman who is suing Hershey, the maker of Reese's, because when she purchased a pumpkin themed version of the candy, she feels she was lied to by the packaging.  

It was during Halloween time and the candy bar was shaped like a pumpkin. On the packaging the pumpkin showed a jack-o-lantern face, however, when she opened the wrapper, it was just a brown candy bar in the shape of a pumpkin. 

For the mountain of disappointment she then suffered and the crushing emotional pain she has gone through since, she is asking for the court to award her $5 million dollars in damages. I think we can all agree it is warranted. Frankly, I think she should ask for more, especially if she ended up eating the faceless treat. 

What would it be like to be the the attorney when someone comes in looking to hire you and this is their story. I know someone well who worked for a firm for many years. I asked her if they had people come in with similar lawsuits. She said it wasn’t all the time, but now and then there was a doosy. 

She said in Utah you can end up paying the opposing attorney’s fees if the judge decides the suit does not have merit. This puts a chill on frivolous lawsuits. Besides, the law firm wouldn’t take a case if it was too out there or would just waste the client’s money. Sometimes they just inform the person that they will not take the case.

I asked her for the dumbest one she ever heard of, and she said she would tell me if I didn’t put her name in the article. What can I say, I’m going to share it, so I will keep her name in confidence. 

One time a woman came to the office and told the attorney she was a psychic and wanted to enter a lawsuit against Tom Cruise. When he asked her why, she said that the actor was currently blocking her psychic abilities and it was costing her money.  

I can’t imagine what you do when you are the attorney sitting across the table from this woman. I would start probing for details. Is he aware he is blocking you? Is it his good looks causing distraction, or does he have his own psychic powers that nullify yours?

Attorneys are often a lot more compassionate and honest than most of us give them credit for. She said he handled it very professionally and apologized to her that they couldn't take it as it would be a hard case to prove in court.

I’m sure Tom Cruise received the news with relief, you know, through his powers.
